Rijiju Hails SC Order on Waqf Act, Calls It a Boost for Parliamentary Democracy

Union Minister for Minority Affairs Kiren Rijiju on Monday welcomed the Supreme Court’s interim order on the Waqf (Amendment) Act, 2025, saying the verdict reflects both trust in institutions and the strength of India’s Parliamentary democracy.

The apex court refused to stay the entire law but put certain provisions on hold until the final adjudication of petitions questioning its constitutional validity.

“We welcome the Supreme Court’s order on the Waqf Act. The government’s solicitor general strongly presented our position. This is a good sign for democracy. Parliament debated this bill extensively in both Houses. While some people challenged it in court, the SC has confirmed that the authority of Parliament cannot be questioned—only specific provisions can,” Rijiju told reporters in Mumbai.

He added that the amended law will bring transparency and accountability in the management of Waqf properties, benefitting poor Muslims, especially women, children, and orphans.

On the SC’s decision to stay some provisions, including the five-year Islamic practice requirement to create a Waqf and the Collector’s role in property disputes, Rijiju said the government will “look into these issues” and work on appropriate rules.

The Waqf (Amendment) Act, 2025, passed by Parliament in April and signed into law by the President, has been one of the most debated legislations of the year.
